An individual’s criminal record is documented in numerous records, including: Court records, police department records, incarceration files at the Department of Corrections and in the state Bureau of Investigation’s arrest and background check documentation. Several types of charges can be expunged (erased) from certain records although in some instances the arresting agency (police department) records may retain the information.
Some records can be completely expunged; some can be granted deferred expungement based on probation requirements; and some requests for expungement are denied. (Note: An expungement is an erasure of records and differs from a pardon, which is forgiveness of the crime but does not seal the crime records.)
